Houston City Attorney Arturo G. Michael presented his recommendation that the city pay $225000 in settlement of a lawsuit arising from the accidental death of following a collision with a city truck. The council approved the decision. In less dramatic instances, citizens frequently present claims of loss or damage to the Mayor and Council, alleging negligence in road maintenance, signage, sidewalk hazards, or improper conduct by city employees.
The council often directs the citizen to the appropriate city official for further resolution.
Successful lawsuits against the city are rare, partly because claims against the city must meet the stringent requirements of the State Tort claims law and the City of Houston Charter.
