Surprise recently reached a $75,000 settlement with a Glendale man who was reportedly injured when he was hit by an unsecured canopy near the Surprise spring-training fields, according to a 2007 notice of claim. Larry Santor, who was attending his son's baseball tournament, said in the claim that the canopy struck his left shoulder and arm. It knocked him to the ground face first, injuring his elbows and knees. The city's lack of information about the settlement was questioned at last week's council meeting by former Surprise Councilman Bob Vukanovich. He criticized city leaders for their failure to post details of the settlement. The settlement, later obtained by The Arizona Republic, required council approval.
City officials forgot to call up Vukanovich as a speaker before a vote was cast. By the time City Clerk Sherry Ann Aguilar realized the error, the council had unanimously approved the payment. "Aren't citizens entitled to know to what the item is, to see more backup?" Vukanovich said, addressing the council. City Attorney Michael Bailey apologized for the misstep. Normally a synopsis of a settled lawsuit is posted with the agenda item. In the Santor case, the item was posted in a hurry because the court ordered the payment to be made within 10 days of the date the settlement was reached, Bailey said.
