Constellation reaches $54M settlement on fly ash lawsuit

A Baltimore County Circuit Court judge approved a $54 million settlement Wednesday to a year-long class action lawsuit brought by a group of Anne Arundel County homeowners against Constellation Energy Group.

The lawsuit — filed last November against Constellation Power Generation, a subsidiary of Constellation — alleged that homeowners’ water supplies were contaminated by fly ash from a Constellation power plant. The ash is produced by the combustion of coal in electricity-generating plants.

The settlement calls for Constellation to pay to convert 84 homes from well water to public water; set up two trust funds to compensate impacted property owners and to enhance the neighborhood; remediate and restore a former quarry site; and cease future deliveries of new coal ash to the quarry.

“This landmark settlement effectively mitigates risks of future harm,” said Hassan Murphy, managing partner of the Murphy Firm, which represented the homeowners, in a statement Wednesday. “This settlement is a milestone in Maryland environmental and legal history.”

Peter Angelos, an attorney and the owner of the Baltimore Orioles, also represented the Anne Arundel County residents in the lawsuit.
