The crash that almost killed Linda Magyary was violent. Now, 6 1/2 years after Linda Magyary's vehicle was hit by a DHL package delivery truck driven by DHL driver Susan McKinley, Ms. Magyary finally received justice in the form of a settlement agreement under which defendants DHL Express, Consolidated Deliveries & Logistics and other defendants have agreed to pay the plaintiff $10,500,000. On the morning of May 23, 2005, Ms. Magyary's car was struck by Susan McKinley's package delivery truck in Lancaster, California. Ms. McKinley ran a red light while travelling over 50 mph and struck the front-passenger side of Magyary's car while Magyary was waiting to make a left turn.
 
Ms. Magyary was trapped in her car for 10-15 minutes before she was extricated and airlifted to the hospital. She lost consciousness and remained in a coma for several days after the crash. She was initially hospitalized for over two weeks and then went between the hospital and a skilled nursing facility for another month. Eventually, Ms. Magyary was discharged to intensive home health care, living assistance and physical therapy. At the time of the crash, the defendant McKinley was in a DHL uniform driving her delivery truck that was used to deliver DHL packages.
 
The investigating Sheriff's Deputy who accompanied McKinley to the hospital after the crash testified that McKinley admitted to smoking marijuana the morning of the crash. At the time of the crash, Ms. McKinley was on her way to the "CD&L" station in Lancaster, California, where all DHL packages that either went to or left the Antelope Valley were sorted and processed for delivery.

A jury has awarded a Burlington Northern Santa Fe Railway employee $2 million in a lawsuit over a 2001 back injury that required surgery and causes chronic pain. The jury returned the verdict Friday after a trial before District Judge Gregory Todd.

Attorney Russell Yerger says Chad Silliker was working in Whitefish in September 2001 when he tripped on a radio handset cord and fell down three steps. Silliker sued BNSF in 2007. Before trial, Todd ruled the railroad could not argue that Silliker contributed to his injury because a trainmaster inadvertently threw away the handset in the years between the injury and when the lawsuit was filed.

A law firm today announced that a wrongful death settlement was reached last week, awarding $3.2 million to plaintiff Na Zhang in a lawsuit previously filed in Riverside County Superior Court . The settlement stems from an incident that occurred in the early morning hours of October 19, 2009, when the plaintiff’s husband, Tangyuan Cao, 33, was stopped in the number one lane of westbound State Route 60, near Country Village Rd, in Riverside County, CA.  Cao’s disabled vehicle was struck from behind at approximately 100 MPH by the defendant’s company-provided pickup truck. As a result of the impact, Cao suffered multiple blunt force injuries and died at the scene of the collision.

According to the lawsuit, moments before the collision, other motorists and witnesses were able to take appropriate evasive action to avoid colliding with Cao’s disabled vehicle. The California Highway Patrol officer investigating the collision found the driver of the pickup truck that struck Cao’s vehicle to be the primary cause of the collision, and noted his violation of California Vehicle Code Section 22350, which states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Discount Rate

In the beginning, the factoring industry had some relatively high discount rates due to heavy expenses caused by costly litigation battles and limited access to traditional investors. However, once state and federal legislation was enacted, the industry’s interest rates decreased dramatically. There is much confusion with the terminology “discount rate” because the term is used in different ways. The discount rate referred to in a factoring transaction is similar to an interest rate associated with home loans, credit cards and car loans where the interest rate is applied to the payment stream itself. In a factoring transaction, the factoring company knows the payment stream they are going to purchase and applies an interest rate to the payment stream itself and solves for the funding amount, as though it was a loan.

Discount rates from factoring companies to consumers can range anywhere between under 8% up to over 18% but usually average somewhere in the middle (link to a discount rate calculator can be found here). Factoring discount rates can be a bit higher when compared to home loan interest rates, due to the fact the factoring transactions are more of a boutique product for investors opposed to the mainstream collateralized mortgage transactions.

Mashantucket Pequot Gaming Enterprises, which operates Foxwoods, had agreed to pay the 68-year-old Murch $2.9 million in actual damages and for the pain and suffering he endured following the November 2006 valet-parking accident that caused him to have his right leg amputated above the knee.

The driver of the standard-transmission vehicle that struck Murch, which had been parked two to three car lengths behind Murch's car, had left it in first gear without engaging the parking brake. While standing outside the vehicle, a valet reached in and started the engine. The vehicle shot forward.

”… It appears Rich (Murch) was initially crushed between the two vehicles, and the force of the collision propelled Rich's car forward,” court documents say. “The (other vehicle) continued forward and knocked Rich down.”

A valet had to get into the vehicle and restart it to get it off Murch's legs, the suit says.

Under the agreement reached Thursday, MPGE and its insurance company, Liberty Mutual, will pay Murch $2,925,000. The company that insured the owner of the vehicle that struck Murch will pay $100,000, bringing the total settlement to $3,025,000.
