Discount Rate

In the beginning, the factoring industry had some relatively high discount rates due to heavy expenses caused by costly litigation battles and limited access to traditional investors. However, once state and federal legislation was enacted, the industry’s interest rates decreased dramatically. There is much confusion with the terminology “discount rate” because the term is used in different ways. The discount rate referred to in a factoring transaction is similar to an interest rate associated with home loans, credit cards and car loans where the interest rate is applied to the payment stream itself. In a factoring transaction, the factoring company knows the payment stream they are going to purchase and applies an interest rate to the payment stream itself and solves for the funding amount, as though it was a loan.

Discount rates from factoring companies to consumers can range anywhere between under 8% up to over 18% but usually average somewhere in the middle (link to a discount rate calculator can be found here). Factoring discount rates can be a bit higher when compared to home loan interest rates, due to the fact the factoring transactions are more of a boutique product for investors opposed to the mainstream collateralized mortgage transactions.

Conduct of proceedings. Must a court conduct a hearing on an application for approval of a transfer of structured settlement payment rights, even if the application is unopposed?

If a hearing is not required to be scheduled under the applicable SSPA(s), or if a hearing is scheduled but no interested party registers any opposition to a proposed transfer, can the court appropriately dispense with a hearing if the applicant submits an affidavit from the payee indicating that the applicable statutory conditions will be fulfilled?

Both sides of lawsuit agreed to a structured settlement regarding case of Teens killed in a 2004 car accident the $2.5 million liability limit included in the insurance policy for the car was refered by the lawyers as the settlement area mark


A contentious case that pitted the parents of two Northeast Kingdom teens killed in a 2004 car accident near Lake Willoughby against the Maryland family of the 14-year-old driver who survived the crash has been settled. According to court papers filed Wednesday at federal court in Burlington, both sides agreed to a structured settlement to resolve the lawsuit. The settlement affirms a Dec. 3 agreement reached after a daylong mediation session between the parties. The settlement figure was not disclosed in court papers, but lawyers for both sides confirmed that the amount was close to the $2.5 million liability limit included in the insurance policy for the car.

"My client is very pleased that the matter has finally been settled and that we have avoided the necessity of a trial," Burlington attorney Marc Heath said. Heath represented Julie Jensen, a wealthy tax lawyer and philanthropist, and her son Charles Meyer. Jensen and Meyer were summer residents of Brownington at the time of the accident. The parents of the two deceased teens, Normand Woolard, 16, and Philip Leno, 17, had contended that Jensen was as much to blame for the fatal accident as Meyer because she bought him a high-performance car and let him drive it even though he didn't have a driver's license.
