Highly regarded Charlotte attorney Herbert W. Auger, of the Auger & Auger law firm, recently obtained a $490,000 personal injury settlement for a client who sustained a number of injuries when the vehicle in which he was a passenger crashed on a South Carolina highway. The settlement was achieved pre lawsuit by Auger with three different insurance companies. The matter did not enter into litigation, so the names of the parties and insurers were kept confidential.

The accident occurred on May 7, 2008, when the Augers’ client, a Florida college student, was a front-seat passenger in a vehicle that was transporting him back to his college campus. While traveling on I-95, just outside of Yemassee, S.C., the driver, lost control of the vehicle causing it to roll several times. The driver was charged with exceeding the posted speed limit. The accident caused the victim to sustain a fractured right clavicle, right hand, right wrist and a partial amputation of his right second toe. He underwent two operations on his wrist and hand which involved the internal fixation of hardware (screws and plate) to secure the fractures.

The family of a Lake County woman who suffered a head injury when her wheelchair tipped over in a county-funded transit bus has accepted $95,000 to settle the lawsuit, according to county documents. Katheryn Trent of Howey-in-the-Hills was injured Jan. 17, 2003, when the public transit vehicle in which she was riding turned a corner, the wheelchair in which she was seated toppled over and she struck her head. The wrongful-death lawsuit claims the "severe head/brain injury" Trent suffered led to her death at age 78 about seven weeks later, though a death certificate filed with her probate case shows she died of a perforated colon.

The payment to Trent's estate was detailed in a liability release, approved this week by county commissioners, clearing LifeStream Behavioral Center of financial responsibility for Lake's legal expenses. LifeStream managed the publicly subsidized, appointment-only transportation service for the county. Filed by Orlando lawyer Konstantine E. Pantas, the lawsuit claimed that Trent's injury was the result of negligence by LifeStream and the driver of the Lake County Transit bus who neglected to lock down her wheelchair. LifeStream and the county denied liability for Trent's injury and subsequent death.

Interim County Manager Sandy Minkoff said the county did not contribute to the financial settlement with Charlotte Pinkerton, Trent's daughter who is listed in her late mother's will as the sole beneficiary of the estate.

The Delaware Valley School District and its insurer have agreed to pay $815,859 to a former elementary school student who was sexually abused by her teacher. The lawsuit filed on behalf of the Freeman family by Jack Cohen, Esquire, of Levy, Baldante, Finney, Rubenstein, Cohen & Chizmar, P.C. contends that school officials, including former Principal Robert L. Smith and former Superintendent James Melody, and current Superintendent Dr. Candis Finan, failed to heed numerous warnings about the teacher's conduct. The student, now 18-years-old, suffers from a multitude of psychological and social concerns.

Smith and former Superintendent James Melody, and current Superintendent Dr. Candis Finan, failed to heed numerous warnings about the teacher's conduct. The student, now 18-years-old, suffers from a multitude of psychological and social concerns.

The former student, identified as SF in the lawsuit, was a 7-year-old at Shohola Elementary School when she was sexually abused by Thomas Harvey Matthews, 51, her third grade teacher. Several years earlier the District had knowledge and documentation of Matthews' inappropriate behavior toward several students and one teacher but "failed to take necessary action", according to Cohen as stated in the civil suit filed in The United States District Court for the Middle District of Pennsylvania.

The suspect's story is now being told as a lesson of where unchecked addiction can lead. He was an inspiration - now he's a lesson. The man accused of killing two people in a New Year's Day car accident while driving under the influence on I-95 in Philadelphia had left a drug recovery house in Middletown two months ago, according to residents at the home. Jesse Maiden, 36, had been known in Bucks County's recovery community as an inspiration, going out of his way to help folks battle their addictions, his former housemates said.

But that changed earlier this year when he received $90,000 in settlement money from a work-related knee injury, his former housemates said. Maiden started using again - his drugs of choice were crack and marijuana - and left the home, his former housemates said. He had been staying there voluntarily, they said. Members of the resident-run home requested that its name not be printed because Maiden was no longer staying there. They asked that their last names not be printed to respect the anonymity of their drug recovery program.

A girl left severely disabled following her birth at a Norfolk hospital has won a multi-million pound compensation payout at the High Court. Tahlia Jade Downes, now 14, was deprived of oxygen during her delivery at the Norfolk and Norwich Hospital. 

Through her mother, Dawn, she sued the hospital's managers, claiming a Caesarean should have been carried out. The hospital denied staff had caused injury but agreed to a settlement expected to run in to several millions. The court heard Tahlia, of Hellesdon, near Norwich, had suffered permanent brain damage, which led to severe mental and physical disabilities and also affected her vision. The hospital agreed before Mr Justice Eady that she should be compensated on the basis of 70% of a full valuation of her claim.
