A roofing death construction lawsuit case has ended. An Ohio work site was the location of a roofing death that happened on top of a high school gym. The roofing worker was killed when he fell through the high school gymnasium roof. The Cleveland based roofing company and their insurance company agreed during a break in the closing arguments of the trial. The terms of the case were kept confidential, though the dollar amount was published on the record for the case.
The roofer was working on the school’s gym in 2008 when a panel from the roof broke under his feet, thus he fell to his death. The law firm representing the roofing worker's family asked the jury for 4 million dollars in damages, arguing that the roofing company was sending the roof worker to a dangerous roof area without safety precautions.
 
Each year, on average, between 150 and 200 workers are killed and more than 100,000 are injured as a result of falls at construction sites.

A disabled young woman who claimed her injuries resulted from contracting a rare disease, most probably from a parrot in a pet store, has secured a multimillion-euro structured settlement likely to well exceed the highest award ever in a High Court personal injuries action.

The previous highest award was 7.5 million for a child with cerebral palsy. The structured settlement agreed yesterday for Patricia Ingle, now aged 22, will pay for the costs of her lifetime care.

It involves an interim payment now of more than 3 million with further payments to follow under a structured agreement to be provided for under new legislation.

The last parts of Section 10139.5 deal with the costs involved in the transfer, and who has to pay those costs. Section (d) to (f) read:


(d) All court costs and filing fees shall be paid by the transferee.

(e) No later than the time of filing the petition for court approval, the transferee shall advise the payee of the payee's right to seek independent counsel and financial advice in connection with the transferee's petition for court approval of the transfer agreement, and shall further advise the payee that if the payee retains counsel, a licensed certified public accountant, or a licensed actuary in connection with a petition for an order approving the transfer agreement, that the transferee shall pay the fees of the payee's counsel, accountant, or actuary, regardless of whether the transfer agreement is approved, and regardless of whether the attorney, accountant, or actuary files any document or appears at the hearing on the application for transfer, in an aggregate amount not to exceed one thousand five hundred dollars ($1,500). The transferee's accountant, counsel, or actuary may not advise the payee.

(f) The court shall retain continuing jurisdiction to interpret and monitor the implementation of the transfer agreement as justice requires.

What this means is that the company buying your structured settlement has to pay all of the court fees involved in the transfer. Section (e) is probably the most important thing to pay attention to, as it states that the company buying your structured settlement must pay (your accountant, attorney, etc.) for your independent professional advice regarding the transfer. It doesn't matter what the conclusion of the professional is; in other words, it doesn't matter if the independent professional advice is "it's fair", or "it's unfair" -- the company trying to buy your structured settlement is the one to pay the independent attorney - not you (the seller). However, this amount can not exceed $1,500.

If you are about to make a financially life-changing decision, it is wise to get the opinion of a detached, independent, and professional opinion.

The crash that almost killed Linda Magyary was violent. Now, 6 1/2 years after Linda Magyary's vehicle was hit by a DHL package delivery truck driven by DHL driver Susan McKinley, Ms. Magyary finally received justice in the form of a settlement agreement under which defendants DHL Express, Consolidated Deliveries & Logistics and other defendants have agreed to pay the plaintiff $10,500,000. On the morning of May 23, 2005, Ms. Magyary's car was struck by Susan McKinley's package delivery truck in Lancaster, California. Ms. McKinley ran a red light while travelling over 50 mph and struck the front-passenger side of Magyary's car while Magyary was waiting to make a left turn.
 
Ms. Magyary was trapped in her car for 10-15 minutes before she was extricated and airlifted to the hospital. She lost consciousness and remained in a coma for several days after the crash. She was initially hospitalized for over two weeks and then went between the hospital and a skilled nursing facility for another month. Eventually, Ms. Magyary was discharged to intensive home health care, living assistance and physical therapy. At the time of the crash, the defendant McKinley was in a DHL uniform driving her delivery truck that was used to deliver DHL packages.
 
The investigating Sheriff's Deputy who accompanied McKinley to the hospital after the crash testified that McKinley admitted to smoking marijuana the morning of the crash. At the time of the crash, Ms. McKinley was on her way to the "CD&L" station in Lancaster, California, where all DHL packages that either went to or left the Antelope Valley were sorted and processed for delivery.

A jury has awarded a Burlington Northern Santa Fe Railway employee $2 million in a lawsuit over a 2001 back injury that required surgery and causes chronic pain. The jury returned the verdict Friday after a trial before District Judge Gregory Todd.

Attorney Russell Yerger says Chad Silliker was working in Whitefish in September 2001 when he tripped on a radio handset cord and fell down three steps. Silliker sued BNSF in 2007. Before trial, Todd ruled the railroad could not argue that Silliker contributed to his injury because a trainmaster inadvertently threw away the handset in the years between the injury and when the lawsuit was filed.
